Nutshell request again.

LOL  Okay, guy has a CHL license and gets mad that his neighbor is playing their music too loud (it's the neighbor's wife's birthday party).  He goes over to the neighbor's driveway and complains to them (while also calling 911).  The neighbor and his friends get pissed that he's brandishing a gun and things escalate.  At no point does the CHL holder retreat back to his home and the neighbor (or one of his friends) appears to make a lunge toward him (can't really see anything cause it's really dark at that point) and the CHL holder opens fire killing the neighbor (and wounding 2 more guests).  You really should see the video with your own eyes when you're at home, though (words can't truly describe what unfolded).

The questions that stand out (at least in my mind) are:
1) What was the 911 operator telling the CHL holder all this time?  (I'd love to hear the 911 call on this one.)
2) Why didn't the CHL holder retreat back to his property if he felt threatened (he appeared to have plenty of opportunity to do so but chose not to)?  At the very least, he should have stepped off the neighbor's property.
3) And the obvious question: What would YOU do if someone showed up on YOUR property brandishing a gun with a similar complaint?

If someone showed up with a gun (especially at a party for my wife and guests), I'd be pretty pissed off.  However, instead of taunting him, I would have sternly commanded him to leave my property and wait for the authorities to show up (which I would hope that the 911 operator was repeatedly telling him to but...who knows until we hear that call).  Just because you're holding a phone to your ear isn't going to make me any less uncomfortable (you could be a damn psycho talking to dead air for all I know).  Granted, I would have immediately gone inside and called 911 myself but keep in mind these guys were probably drinking (it was a party after all), too.  The CHL holder, on the other hand, appeared to be completely sober.

I'm not sure he should be found guilty of murder but I'm guessing perhaps manslaughter (really depends on additional facts which I'm curious to see).  Either way, yet another disaster involving a CHL holder and making the rest of us look bad.

I watched it earlier today, my first thought was they should throw him under the jail.  What a dumbass.

So he was in his neighbor's driveway yelling to turn the music down, one of the people walked up to him, then he drew his gun and threatened to shoot the guy.

Seems like a really bad reaction that helped cause the whole thing. I don't think I'd draw as my first reaction to a party goer coming up to me to see what I was yelling about. I do know lots of stupid drunks though, of course tough guy drunks are going to mess (admin edit for language) with you after you draw a gun on them.

Ok, here is how it SHOULD have happened. YOU, the complainee, calls 911 about the loud obnoxious party your neighbors are throwing. You stay in your house until police arrive. Nobody is shot, the end. I honestly dont care if I am having a loud party, if someone shows up on my property waving a gun around making threatening gestures, I am dropping their ass. You dont come on my property threatening me and my guests under no circumstances. Like it was said above, throw this idiot under the jail, gives the rest of us CHL holders a bad name.

I'll have to watch it later for sure. But going off the nutshelling..........

Yeah, I'd at MINIMUM just get off the neighbor's property, and probably just go home. But if I had a complaint about a party I would go over and ask something be done and GO HOME. If nothing was done, then I'd call the police FROM MY HOME and not go back over at all.

If it was MY party, and someone walks up in MY driveway threatening people with a gun I'd tell everyone to go either inside or in the back (away from the guy with a gun) and call 911. I'd stay where I could see him but not engage him verbally or physically once his gun came out. If he AIMED it at anyone on my property I'd drop him.

But break it down simple.

1-your on someone ELSE'S property, uninvited, and of your own free will.
2-a UNARMED man approaches you and let's say you feel threatened.
3-you can EASILY leave the property but don't.
4-you end up killing the unarmed man.

I know you have no duty to retreat here, but that ALL seems to be offensive moves. A CHL holder's gun is STRICTLY a defensive weapon. Soooo, yeah, jail for this dude.

Totally.

That guy really did get a high off of wandering around with a gun; there was no reason for anyone to die or get injured. My very first thought was "Why on EARTH didn't he just call the police about noise ordnance violations?" Even if the deceased man escalated the situation purposefully or not, it took him quite a while to do so.

Most annoying part of the whole thing was the guy BS-ing the "my life is in danger" part. If the media gets a hold of that "he's using shock-terminology they teach all CHL holders to use!" line, the possibilities are black and endless. What an idiot. :bangheadonwall:
