Nutshell request again.
LOL Okay, guy has a CHL license and gets mad that his neighbor is playing their music too loud (it's the neighbor's wife's birthday party). He goes over to the neighbor's driveway and complains to them (while also calling 911). The neighbor and his friends get pissed that he's brandishing a gun and things escalate. At no point does the CHL holder retreat back to his home and the neighbor (or one of his friends) appears to make a lunge toward him (can't really see anything cause it's really dark at that point) and the CHL holder opens fire killing the neighbor (and wounding 2 more guests). You really should see the video with your own eyes when you're at home, though (words can't truly describe what unfolded).
The questions that stand out (at least in my mind) are:
1) What was the 911 operator telling the CHL holder all this time? (I'd love to hear the 911 call on this one.)
2) Why didn't the CHL holder retreat back to his property if he felt threatened (he appeared to have plenty of opportunity to do so but chose not to)? At the very least, he should have stepped off the neighbor's property.
3) And the obvious question: What would YOU do if someone showed up on YOUR property brandishing a gun with a similar complaint?
If someone showed up with a gun (especially at a party for my wife and guests), I'd be pretty pissed off. However, instead of taunting him, I would have sternly commanded him to leave my property and wait for the authorities to show up (which I would hope that the 911 operator was repeatedly telling him to but...who knows until we hear that call). Just because you're holding a phone to your ear isn't going to make me any less uncomfortable (you could be a damn psycho talking to dead air for all I know). Granted, I would have immediately gone inside and called 911 myself but keep in mind these guys were probably drinking (it was a party after all), too. The CHL holder, on the other hand, appeared to be completely sober.
I'm not sure he should be found guilty of murder but I'm guessing perhaps manslaughter (really depends on additional facts which I'm curious to see). Either way, yet another disaster involving a CHL holder and making the rest of us look bad.
